Advertising your products and services. What should you know
about advertising. Advertising your products and services. What should you know about advertising. Advertising is the general method of promoting products and services. Sellers should know the advertising rules to avoid getting into the legal trouble. Before you start your advertising complain, there is something you should know about the advertising law. Advertisements are the preliminary negotiations, rather than offers to sell. Descriptions of goods in mail-order catalogues or on the Internet are called preliminary negotiations rather than offers, even though the goods are described in detail and a specific price is set for each article. The same view is usually taken of price quotations that companies send out to their customers. Therefore, when one orders goods from a catalogue, the Internet or in response to a quotation, the order does not constitute an acceptance. The placing of the order is instead an offer to purchase made by the buyer, which the firm may accept or reject as it pleases. The widely accepted general rule is that a store advertisement that merely names the company, describes the article to be sold, and gives the price of the article “constitutes nothing more than an invitation to shop at the store.” And this is usually true even if the terms “offer” or “special offer” appear in the advertisement. Most advertisements are silent on other material matters, such as the available quantity and credit terms, and on the traditional principle that sellers of goods have the right to choose the parties with whom they deal. Thus, because the vast majority of advertisements fall within the general rule, a contract is normally not formed when a purchaser goes to advertiser's store and requests that an article be sold at the ad vertices price- Under this rule, such at an offer to purchase rather than an acceptance which the advertiser may either accept or reject. Advertising Rules: In the effort to limit abuses
of the common-law rule by unscrupulous advertisers, practically all states
have passed the advertising law. It provides civil or criminal liability for
businesses that refuse to sell goods or services as it was advertised. In
other words, if the company refuses to sell products or services as they
were advertised, they are at risk of having a law suit.
