Dispute resolution in court is
stressful, expensive and time consuming matter. Nothing can be compare
with tension in a court room. The dispute resolution in court is not the
only alternative to resolve the dispute. In fact, it better for all to
avoid the lawsuit.
Out-of-court Settlement.
Many disputes are resolved out of court room - either by compromise
or by one party giving up. The majority of business disputes involves
money. The parties may agree on smaller amount of money, due date
extension or simply decided to accept the loss in order to preserve good
relationship with the customer. The decision often depends on amount of
money involved, time required to attend court sessions, attorney's and
other legal fees required to resolve the dispute.
One of the methods to settle a dispute is through an arbitration
agreement. This procedure is popular in the business world. The
disputing parties choose and submit one or several arbitrators to
resolve the dispute in their behalf. The advantages of this method are:
quick dispute resolution, low cost.
Another popular out-of-court dispute resolution method is Mediation.
Mediation is method of resolving dispute by involving a third party. The
role of mediator is to improve communication between parties,
narrow down the nature of the dispute and recommend possible compromise.
The difference between the mediator and arbitrator is that the mediator
can only suggest the possible solution, but canon influence the final
resolution between parties. Mediators are often used in resolving the
dispute between the Union and Management.
